What is insurance for doctors and hospitals?
Insurance for doctors and hospitals is a set of covers that protect medical professionals and healthcare facilities against negligence claims, damage to their premises and equipment, and the health costs of their staff. At its core is medical professional indemnity, which pays defence costs and compensation when a patient alleges that treatment was negligent. Around it sit property, equipment, liability and employee benefit policies.
This page is part of our liability insurance section because malpractice claims are the largest single risk in medical practice.
Why medical indemnity matters in India
Medical services are treated as services under consumer protection law, so patients can file complaints before consumer commissions as well as civil courts. Doctors can also face complaints before medical councils and, in serious cases, criminal proceedings. Awards have grown over the years, and even a weak complaint needs expert defence. Hospitals face vicarious liability for their staff, and claims often name the institution and several doctors together.
Cover for individual doctors
A doctor’s professional indemnity policy is a specialised form of professional indemnity insurance. It usually covers:
- Compensation awarded for bodily injury or death caused by an error or omission in professional services.
- Legal defence costs, including expert opinions, before consumer commissions and courts.
- Work done before the policy began, back to the retroactive date, if cover has been continuous.
- In some wordings, costs of defending medical council or disciplinary proceedings.
Premiums depend mainly on the speciality. Surgeons, obstetricians, anaesthetists and cosmetic practitioners pay more than general physicians or pathologists. Doctors working in several hospitals should confirm that the policy follows them to every place of practice.
Cover for hospitals, nursing homes and clinics
| Risk | Suggested cover |
|---|---|
| Negligence by the institution or its staff | Hospital professional indemnity (errors and omissions) |
| Fire, flood, storm damage to building and contents | Standard fire and special perils policy or a Bharat package, depending on value |
| MRI, CT, X-ray, lab and ICU equipment | Electronic equipment insurance |
| Injury to visitors and attendants on the premises | Public liability insurance |
| Cash, burglary and patient records | Money, burglary and cyber covers |
| Staff health and accident costs | Group health and group personal accident insurance |
What is not covered
- Criminal acts, practising while under the influence, and treatment outside the declared speciality or qualifications.
- Guarantees of a particular result, including many cosmetic outcomes, unless specifically covered.
- Claims known or pending before the policy started.
- Fines, penalties and punitive damages.
- Practice by unqualified or unregistered staff.
How the premium and limits are decided
For individual doctors, insurers look at speciality, qualifications, years of practice, procedures performed and claims history. For hospitals, they consider bed count, departments, number of doctors and nurses, surgeries and deliveries per year, accreditation, infection control, consent processes and record keeping. The limit of indemnity should reflect the seriousness of the procedures performed, not only the cost of the policy.
How MILES helps
- Build a complete programme: we review your practice and list every risk, so indemnity, property, equipment and staff benefits work together.
- Compare insurers: we collect terms from several insurers and compare limits, retroactive dates, deductibles and exclusions.
- Check equipment values: we help set replacement values for high-cost machines so claims are not reduced for underinsurance.
- Protect continuity: we keep retroactive dates intact when you move insurers or open a new practice.
- Support claims: we help you respond to legal notices, arrange documents and work with the insurer’s panel counsel.
What we need for a quote
- For doctors: speciality, registration, qualifications, places of practice and procedures performed.
- For hospitals: bed count, departments, staff numbers and annual procedures.
- Property and equipment lists with current replacement values.
- Staff list with ages for group health cover.
- Existing policies and claims history.
Cover, exclusions and premiums depend on the insurer’s policy wording and underwriting. MILES Insurance Brokers Pvt. Ltd. is an IRDAI-licensed direct broker (Life & General, Reg. No. 954); the insurance is issued by the insurer. Insurance is the subject matter of solicitation.
