Employment Practices Liability Insurance

Cover For Claims Brought By Your Own People

Allegations of wrongful termination, discrimination or workplace harassment can reach labour courts, civil courts and the media, and defending them is expensive even when the company has done nothing wrong. Employment Practices Liability (EPL) insurance pays defence costs and covered settlements for claims brought by employees, former employees and job applicants. MILES helps employers of every size understand what EPL covers, choose a suitable limit and pair it with their existing management liability programme.

What EPL Insurance Covers

Wrongful Termination

Claims that an employee was dismissed unfairly, in breach of contract or without following the proper process.

Discrimination Allegations

Allegations of unfair treatment in hiring, pay or promotion because of gender, caste, religion, age or disability.

Harassment Claims

Defence of claims alleging sexual or other workplace harassment, including allegations about how complaints were handled.

Legal Defence Costs

Lawyers' fees for labour court, civil court and tribunal proceedings, advanced as the matter progresses.

Retaliation And Defamation

Claims that an employee suffered retaliation for whistleblowing, or that a reference or statement damaged their reputation.

Third-Party Option

Optional cover for discrimination or harassment claims made by customers, vendors or other outsiders, where offered.

What is employment practices liability insurance?

Employment Practices Liability (EPL) insurance covers a company, and usually its directors, officers and employees, against claims by employees alleging wrongful employment practices such as unfair dismissal, discrimination, harassment or retaliation. It pays defence costs and the settlements or awards the insured is legally liable to pay. It covers the legal dispute, not the employee’s wages or statutory dues.

EPL belongs to our liability insurance range and is often bought as an extension to, or alongside, directors and officers liability insurance.

Why EPL is growing in India

Indian workplaces are more aware of their rights than ever. The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 requires employers to run internal committees and handle complaints properly, and the handling itself is frequently challenged. Restructuring, layoffs and performance exits in technology and start-up sectors have increased termination disputes. Employees also post allegations on social media, making early legal advice important. Multinational parents often ask their Indian subsidiaries to carry local EPL cover in line with group standards.

What the policy covers

  • Wrongful dismissal, discharge or termination, including constructive dismissal.
  • Discrimination in recruitment, pay, promotion or benefits.
  • Sexual and non-sexual harassment, and hostile work environment allegations.
  • Retaliation against employees who raise complaints or blow the whistle.
  • Wrongful discipline, demotion, denial of tenure or failure to promote.
  • Employment-related defamation, invasion of privacy and misrepresentation.
  • Defence costs in labour, civil and quasi-judicial forums.

What is not covered

  • Wages, bonuses, gratuity, provident fund, severance and other contractual or statutory dues.
  • Bodily injury at work, which is handled by employees’ compensation insurance.
  • Obligations under labour welfare, pension, social security and industrial disputes law, such as reinstatement orders beyond covered damages.
  • Deliberate, fraudulent or criminal acts once established.
  • Claims and circumstances known before the policy began.
  • Fines, penalties and the cost of complying with an order to change policies or practices.

How the limit and premium are decided

Insurers look at the total number of employees and their locations, salary bands, attrition, recent or planned layoffs, the quality of HR manuals and grievance systems, the functioning of the internal committee, and past employment claims. Operations in the USA or other litigious countries are rated separately. EPL is written on a claims-made basis, so the retroactive date and continuous renewal matter. A retention, or deductible, applies to each claim and is often higher for claims involving senior staff. Clear HR documentation, consistent exit processes and a well-run internal committee help both the premium and the defence.

Who needs EPL cover?

  • IT, ITES, BPO and technology companies with large, mobile workforces.
  • Start-ups and growth firms that hire and restructure quickly.
  • Banks, financial services, hospitality, retail and healthcare employers.
  • Indian subsidiaries of foreign groups that must follow global insurance standards.

How MILES helps

  • Review HR exposure: we look at headcount, policies and dispute history to present the risk fairly to underwriters.
  • Compare insurers: we obtain terms from several insurers and compare limits, retentions, third-party options and exclusions.
  • Coordinate with D&O: we check how EPL and D&O interact so the same claim is not caught between two policies.
  • Check the key definitions: we read the definitions of employee, claim and wrongful employment practice, which decide whether a dispute is covered.
  • Help at notice stage: we help you report demand letters and complaints promptly and agree defence counsel with the insurer.

What we need for a quote

  • Completed EPL proposal form.
  • Employee numbers by country and location, and attrition for the last two years.
  • Copies or summaries of HR, grievance and POSH policies.
  • Details of any layoffs, restructuring or closures in the last three years or planned.
  • List of pending or past employment claims and existing policy details.

Cover, exclusions and premiums depend on the insurer’s policy wording and underwriting. MILES Insurance Brokers Pvt. Ltd. is an IRDAI-licensed direct broker (Life & General, Reg. No. 954); the insurance is issued by the insurer. Insurance is the subject matter of solicitation.
